INTRODUCTION

These Terms and Conditions (“Terms”) constitute a legally binding agreement governing your access to and use of the MedicoExam platform and associated digital services. By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms without modification. If you do not consent to these Terms, you must not access or use the platform.

MedicoExam may modify or update these Terms at its discretion without prior notice. Continued use of the platform following any modifications constitutes acceptance of the updated Terms. These Terms supersede all prior or contemporaneous agreements, representations, or understandings between the parties concerning the subject matter herein.

NATURE OF SERVICES

MedicoExam provides digital simulation-based certification test preparation for healthcare-related licensing and credentialing examinations. These services include simulated exam questions, timed environments, full and mini exam modes, score displays, attempt history, performance analytics, and user dashboard features.

The platform does not provide certification, academic credits, medical licensure, clinical training, tutoring, coursework, or employment placement. MedicoExam is intended exclusively as a study resource and shall not be construed as formal instruction, credentialing authority, or medical education. Platform outputs are not predictive of official exam outcomes.

NO AFFILIATION WITH CERTIFICATION VENDORS

MedicoExam is not affiliated with, endorsed by, sponsored by, approved by, or connected to any official certification vendor, healthcare licensing board, testing authority, academic institution, accreditor, state or federal licensing agency, or professional organization. References to exam titles, frameworks, scoring procedures, blueprints, trademarks, or credential names (including NCLEX®, NREMT®, AAPC®, AHIMA®, ANCC®, NHA®, NBRC®, RHIT®, RHIA®, and related credentials) are used strictly under nominative fair use for descriptive identification and compatibility purposes only. All trademarks and credential names remain the property of their respective owners. MedicoExam does not represent or imply endorsement, review, accreditation, approval, alignment, evaluation, equivalency, outcome assurance, conformity, compliance, curriculum matching, blueprint matching, or partnership by or with any credentialing authority.

USER ELIGIBILITY

The platform may only be used by individuals who are legally capable of entering binding contractual agreements and who are at least eighteen (18) years of age. By using the platform, you represent and warrant that you meet these requirements. Users bear all responsibility for ensuring that platform usage is lawful within their jurisdiction. Usage by minors is expressly prohibited.

ACCOUNT REGISTRATION AND SECURITY

To access simulation features including demo or premium exams, users must create an account and provide accurate and complete registration information. Users are solely responsible for safeguarding login credentials and preventing unauthorized access to their account. Any activity conducted under a user account is deemed the responsibility of that user. MedicoExam may suspend, restrict, or terminate accounts suspected of fraud, misuse, sharing, or violation of these Terms, with or without notice.

PROHIBITED CONDUCT

Users shall not, directly or indirectly:

  • Copy, scrape, download, harvest, or redistribute platform content or question materials.
  • Reverse engineer, decompile, modify, or derive works from the platform or its software.
  • Use the platform to facilitate cheating, test fraud, academic misconduct, certification malpractice, or the exchange of exam recalls, dumps, or leak-based materials.
  • Sublicense, resell, share, or provide institutional/group access.
  • Automate interactions using bots, scrapers, or programmatic tools.
  • Introduce malicious code, interfere with platform infrastructure, or breach security controls.
  • Impersonate any person, entity, or certification candidate.

Any violation of this section constitutes material breach and may result in access termination, evidence preservation, denial of refunds, or further enforcement actions.

INTELLECTUAL PROPERTY RIGHTS

All platform content, including questions, dashboards, graphics, exam simulations, analytics, software, user interfaces, trademarks, workflows, and technical architecture, is the exclusive property of MedicoExam or its licensors. Users receive a limited, non-transferable, non-sublicensable, non-exclusive, revocable license to access such content solely for personal, private, individual study purposes. No ownership rights are conveyed. Unauthorized reproduction, sharing, distribution, or institutional usage constitutes infringement and may give rise to legal remedies.

EXAMINATION INDEPENDENCE

The platform does not claim equivalence to any real certification examination. MedicoExam does not control or influence exam blueprints, scheduling rules, scoring curves, retake windows, eligibility determinations, or pass/fail criteria established by official certification vendors or credentialing bodies. Simulation results and analytics are informational and non-predictive. Certification outcomes remain solely within the authority of the respective credentialing entity.

ORDERS, PAYMENTS, AND TRANSACTIONS

All orders submitted through the platform are subject to acceptance by MedicoExam. Payment processing may be conducted through third-party providers including credit card processors or PayPal. Users are responsible for any currency conversion fees, foreign exchange charges, or banking surcharges assessed by financial institutions. MedicoExam reserves the right to decline or cancel orders suspected of fraud, misuse, or chargeback risk.

PREMIUM ACTIVATION AND ACCESS DURATION

Premium access requires payment verification and may involve manual fraud or authenticity validation performed by payment processors. Activation may take up to six (6) hours to complete. Access durations are fixed (typically sixty (60) days unless otherwise stated) and commence at activation. Premium access expires automatically at the end of the term without renewal, extension, or proration. Subsequent access may be obtained through new purchase transactions.

CONTENT UPDATES AND SERVICE MODIFICATIONS

MedicoExam may, at its discretion, modify, expand, remove, or enhance content at any time without notification. Such modifications may include the addition or revision of questions, adjustments to simulation features, or refinement of analytics intended to reflect changes in exam blueprints, credentialing requirements, or industry practices. Content updates shall not constitute grounds for refunds, credits, or extensions. MedicoExam does not guarantee continuity of any specific feature, exam simulation format, or performance metric. Users acknowledge that credentialing landscapes evolve and that updates are intended to maintain relevance and quality.

DEMO ACCESS

Demo access may be provided without financial consideration but may require account registration. Demo access is intended for preview, evaluation, and familiarization purposes. Demo access does not guarantee availability of premium features, analytics, result tracking, or full exam content. MedicoExam may modify, limit, or remove demo access at any time.

DATA HANDLING, STORAGE, AND AUTOMATIC DELETION

User information, including personal data, account details, and simulation results, shall be handled in accordance with the separate MedicoExam Privacy Policy. MedicoExam may automatically delete simulation history, analytics, or performance records sixty-five (65) days after creation, expiration of premium access, or account inactivity. Such deletion shall not be deemed breach of duty, data loss, or failure of service. Users acknowledge that the platform is not intended as a data archival service and that data may not be retrievable after deletion. Users consent to such deletion mechanisms and waive claims relating to removed data.

USER RESPONSIBILITIES AND RISK ASSUMPTION

Users are solely responsible for decisions relating to certification registration, scheduling, payment, compliance with eligibility standards, and preparation strategy. MedicoExam does not assist with exam registration, documentation, scheduling, retake approvals, credentialing authority communications, clinical requirements, or licensing applications. Users assume all risks associated with reliance upon simulation scores, analytics, or subjective difficulty estimates, acknowledging that performance on the platform is not indicative of official exam outcomes.

MISCONDUCT AND TEST INTEGRITY

Users shall not leverage the Platform for improper purposes including, without limitation, test fraud, cheating, dissemination of proprietary exam materials, or the solicitation, trafficking, recollection, disclosure, or exchange of real exam items, recalls, memory dumps, or other content prohibited by certification vendors. MedicoExam does not solicit, encourage, accept, or utilize confidential exam content, exam recalls, or vendor-prohibited materials. Any attempt by Users to submit, transmit, upload, or request such materials constitutes misconduct and may result in account termination, refusal of refunds, evidence preservation, and cooperation with certification vendors or legal authorities if lawfully compelled.

TEST SECURITY AND CREDENTIALING COMPLIANCE STATEMENT

MedicoExam supports ethical test preparation and acknowledges the independent authority of certification vendors, credentialing bodies, licensing boards, and testing administrators to maintain exam security, confidentiality, and integrity. MedicoExam does not solicit, obtain, accept, purchase, utilize, or distribute confidential exam content, real exam questions, memory-based recalls, proprietary blueprints, or other materials prohibited by certification vendors or test administrators. MedicoExam does not facilitate cheating, circumvention, or misconduct in certification examinations.

Users are strictly prohibited from submitting, uploading, or disclosing confidential exam content, exam recalls, memory-based items, or any materials obtained in violation of certification authority rules, non-disclosure agreements, test security agreements, or candidate conduct policies. MedicoExam may act to suspend or terminate accounts in cases of suspected misconduct, fraud, or test security violation. MedicoExam shall not be construed as competing with certification authorities nor as interfering with test administration, credentialing standards, licensure determinations, or test security operations. Nothing in these Terms modifies or supersedes user obligations imposed by certification vendors, testing administrators, or licensing authorities.

INTELLECTUAL PROPERTY CLAIMS AND ENFORCEMENT

Unauthorized reproduction, distribution, sublicensing, or institutional use of MedicoExam content constitutes infringement. MedicoExam reserves the right to pursue legal, injunctive, or administrative remedies to prevent ongoing or future infringement. Users shall indemnify MedicoExam for losses arising from infringement conducted intentionally or negligently through their account. MedicoExam may deploy technological means to safeguard intellectual property including watermarking, behavioral analysis, automated access control, throttling systems, or geo-restrictions.

NO MEDICAL ADVICE

The Platform does not provide medical advice, clinical judgment, diagnosis, patient-care recommendations, treatment protocols, or substitute for accredited medical, clinical, or academic education. The Platform shall not be construed as clinical training, competency validation, licensure preparation curriculum, continuing medical education (CME/CE), or formal instructional coursework. Users agree not to apply Platform content in clinical settings, emergency environments, telemedicine interactions, or patient-care scenarios. MedicoExam disclaims all liability for misuse of simulation content in real-world medical or patient-care contexts.

PERFORMANCE ANALYTICS DISCLAIMER

Performance analytics, including scoring outcomes, weak-area indicators, readiness estimates, and comparison metrics, constitute informational tools and are not predictive, guaranteed, or authoritative representations of candidate performance on official exams. Credentialing authorities may utilize scoring frameworks, adaptive logic, clinical scenarios, or blueprint weightings not replicated by MedicoExam. Users acknowledge that certification vendors may modify exam structures at any time and that simulation analytics cannot assure pass results.

NO RELIANCE AND NO GUARANTEE OF SUCCESS

Users expressly acknowledge that MedicoExam does not guarantee exam success, credential acquisition, licensure, employment, hiring, advancement, or professional placement. Platform simulations are not substitutes for official examinations nor do they replicate clinical or operational environments. Users waive reliance on any representation, oral or written, regarding likelihood of passing official exams based on simulation results or study time.

MONEY-BACK GUARANTEE (REFERENCE)

MedicoExam may, for select certifications, offer a separate Money-Back Guarantee policy (“MBG Policy”). That policy governs refund conditions, required documentation, eligibility criteria, and definition of official exam failure. The MBG Policy constitutes the sole contractual exception to the general no-refund policy contained herein. Refund eligibility is determined exclusively by MedicoExam following documentation review and verification. Users shall not initiate chargebacks to pursue MBG-covered refunds and acknowledge MBG requests must be submitted directly to MedicoExam.

REFUNDS, RETURNS, AND NO REFUND POLICY

Except where expressly governed by the MBG Policy or where required by applicable law, all purchases are final, non-cancellable, and non-refundable. Users acknowledge and agree that Premium digital access constitutes legally sufficient “delivery” of goods and/or services upon activation of the User’s account, regardless of usage volume, attempt frequency, or exam outcomes. Digital delivery shall be deemed complete upon activation and not contingent upon user engagement, time spent, or specific results. Non-usage, dissatisfaction, scheduling changes, eligibility determinations, or other circumstances shall not be grounds for refund, reversal, cancellation, or chargeback. Refund rights shall not apply after activation has commenced unless MBG criteria are satisfied.

CHARGEBACKS AND DISPUTE RESTRICTIONS

Users agree not to initiate chargebacks, disputes, or transaction reversals except where legally justified. Unauthorized chargebacks constitute breach of these Terms. MedicoExam reserves the right to dispute chargebacks, submit evidence to payment processors, suspend accounts, blacklist users, and prohibit future purchases. Chargebacks shall not substitute for MBG requests, refund inquiries, or customer support correspondence.

TERMINATION AND ACCOUNT SUSPENSION

MedicoExam may suspend, restrict, or terminate user accounts for breach of these Terms, suspicion of fraud, unauthorized sharing, chargeback initiation, intellectual property infringement, or unethical usage. Termination may occur with or without notice. Upon termination, digital access ceases immediately and no refunds shall be issued except under the MBG Policy where applicable. Following termination, MedicoExam may retain certain data for compliance, fraud prevention, or evidentiary purposes.

DISPUTE RESOLUTION AND ARBITRATION

All disputes, controversies, claims, or disagreements arising out of or relating to these Terms, the Platform, transactions, or any interaction between the User and MedicoExam shall be resolved exclusively through confidential binding arbitration. Arbitration shall constitute the sole mechanism for dispute resolution and shall replace judicial, administrative, or class-based remedies. Users knowingly waive any right to trial by jury or participation in class actions, consolidated actions, representative suits, or collective proceedings. Arbitration proceedings shall be administered by an arbitration provider selected by MedicoExam on a case-by-case basis, and such provider’s procedural rules shall apply unless mutually modified in writing. All arbitration awards shall be final and binding and may be confirmed in any court of competent jurisdiction solely for enforcement purposes. Arbitration shall be conducted virtually unless determined otherwise by MedicoExam at its discretion, and Users consent to remote proceedings.

GOVERNING PRINCIPLES AND VENUE

These Terms shall be governed by principles of arbitration and contract interpretation without reference to conflict-of-law rules. No jurisdiction’s substantive consumer or commercial laws shall apply unless mandated by non-waivable statutory protections. Courts shall lack authority over disputes except where required exclusively for enforcement of arbitration awards. Users understand and agree that no representation of domicile, presence, or establishment shall be inferred from Platform accessibility, domain usage, or operational capability.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, MedicoExam shall not be liable for any indirect, incidental, consequential, exemplary, punitive, special, or economic damages, including loss of profits, business interruption, employment impacts, credentialing denials, license delays, scheduling disruptions, academic outcomes, data loss, or reputational harms. Liability for direct damages, if any, shall be strictly limited to the aggregate amount paid by the User for the applicable premium product during the relevant access term. Users acknowledge that digital services inherently involve risk, including outages, data deletion, trial-feature limitations, and unpredictable certification rule changes beyond the control of MedicoExam.

WARRANTY DISCLAIMER

The Platform is provided strictly on an “as is” and “as available” basis without warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, timeliness, or non-infringement. MedicoExam does not warrant uninterrupted access, error-free operation, compatibility with User devices, or precise simulation of certification exams.

FORCE MAJEURE

MedicoExam shall not be held liable for failure or delay in performance where such failure is caused by conditions beyond reasonable control, including but not limited to natural disasters, epidemics, war, sanctions, political unrest, governmental actions, infrastructure failure, cyberattacks, payment processor disruptions, telecommunications outages, or acts of third parties not under MedicoExam’s direction or control.

COMPLIANCE WITH LAWS

Users shall comply with all applicable laws, regulations, and certification authority rules relevant to examination preparation, credentialing, and test integrity. MedicoExam does not guarantee that Platform use complies with licensure, academic, or regulatory frameworks applicable to the User’s jurisdiction. Users assume responsibility for ensuring lawful use.

NON-ASSIGNMENT

Users may not transfer, assign, delegate, or sublicense rights or obligations arising from these Terms without written consent from MedicoExam. Any attempt to assign or transfer by operation of law or otherwise shall be void. MedicoExam may assign, transfer, or delegate rights at its discretion without requiring User consent.

SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, such provision shall be modified to achieve enforceability to the maximum lawful extent. The remaining provisions shall remain valid and enforceable without impairment.

SURVIVAL

Sections relating to ownership, intellectual property, confidentiality, disclaimers, indemnity, payment disputes, refund limitations, arbitration, limitation of liability, and governing principles shall survive termination or expiration of User access.

NOTICES AND COMMUNICATIONS

All notices or communications to MedicoExam relating to contractual or legal matters shall be submitted via email to the designated contact address published on the Platform. Users agree that notices delivered electronically satisfy any legal requirement for written communication. MedicoExam may communicate with Users via email or through Platform notices.

NO WAIVER

No failure or delay by MedicoExam in exercising any right or remedy shall constitute waiver of that right or remedy. Waiver shall be valid only if executed in writing by an authorized representative of MedicoExam.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between the User and MedicoExam concerning the subject matter herein and supersede all prior negotiations, understandings, representations, or agreements. No oral statements, marketing materials, testimonials, or platform communications shall modify or supplement these Terms unless expressly incorporated through formal amendment.

ACCEPTANCE AND CONSENT

By accessing or using the Platform, Users represent and warrant that they have read, understood, and accepted these Terms. Continued use of the Platform after modifications or amendments shall constitute binding acceptance of such changes.
